TERMS AND CONDITIONS OF USE - TRAVEL CLASSIFIEDS

WELCOME TO TRAVEL CLASSIFIEDS. BY ACCESSING OR USING OUR PLATFORM, YOU FULLY AGREE TO THESE TERMS.

1. ACCEPTANCE OF TERMS

By creating an account, posting an ad, or using any functionality of the Travelclassifieds.org website (hereinafter "Platform"), the user ("Contracting Party") declares to have read, understood, and agreed to all clauses of this instrument.

If you do not agree with any part of these Terms, you must immediately stop using the Platform.

2. DEFINITIONS

For the purposes of this instrument, it is considered:

Platform: The Travelclassifieds.org website and all its subdomains and related services.
User/Contracting Party: Any individual or legal entity that accesses, registers, or uses the Platform.
Advertiser: User who posts offers, vacancies, or services.
Interested Party: User who responds or applies to ads.
Content: Texts, images, videos, links, and other information inserted by users.
Comments: Manifestations, evaluations, replies, or rejoinders exchanged between users within the Platform environment.

3. PURPOSE OF THE PLATFORM

The Platform acts exclusively as an online classifieds, functioning as a virtual intermediation environment to connect people interested in opportunities related to travel, exchanges, volunteer work, cultural experiences, and related modalities.

Travel Classifieds IS NOT a party to any negotiation, contract, or agreement entered into between users, limiting itself to providing the technological infrastructure for posting ads.

4. REGISTRATION AND USER ACCOUNT

4.1. To use the full functionalities of the Platform, the user must create an account, providing true, accurate, and updated information.

4.2. The user is solely responsible for safeguarding their password and access data.

4.3. Any activity carried out in the account will be the responsibility of the holder.

4.4. Travel Classifieds reserves the right to suspend or cancel accounts that violate these Terms or show signs of fraud.

5. RULES FOR POSTING ADS

5.1. The advertiser declares to be the legitimate owner or to have authorization to disclose the ad content.

5.2. It is forbidden to post ads that:

Contain false, misleading, or fraudulent information;
Promote discrimination of any kind (race, gender, religion, sexual orientation, origin, physical condition, etc.);
Involve illegal activities or violate third-party rights;
Contain offensive, violent, pornographic content or that incites hatred;
Collect data from other users without authorization.

5.3. The advertiser is solely responsible for complying with local and international laws related to their offer.

6. COMMENTS AND INTERACTIONS BETWEEN USERS

6.1. The Platform allows the exchange of comments, evaluations, and messages between advertisers and interested parties as a way to promote transparency and community building.

6.2. Travel Classifieds DOES NOT carry out prior moderation of comments exchanged between users, acting only as a provider of the technological infrastructure to enable such interactions.

6.3. EXCLUSIVE USER RESPONSIBILITY:

6.3.1. The user who receives comments they consider aggressive, defamatory, slanderous, injurious, or that in any way harm their image is solely responsible for taking whatever measures they deem appropriate against the aggressor.

6.3.2. Travel Classifieds has no obligation to arbitrate, judge, or intervene in conflicts arising from comments exchanged between users, limiting itself to providing the digital environment for such interactions.

6.3.3. COMMENT APPROVAL:

Users will have the power to approve comments before they are published, as this feature is available to everyone. Approval is their responsibility.

6.3.4. The user who feels harmed by comments from third parties may:

Use the Platform's reporting tools to flag manifestly abusive content;
Take legal or extrajudicial action against the author of the comments;
Publicly expose, by their own means, the conduct they consider abusive, assuming full responsibility for such exposure.

6.3.5. By publicly exposing their aggressor outside the Platform, the user releases Travel Classifieds from any responsibility related to such exposure, answering fully for their acts.

6.4. RIGHT OF REPLY:

The user who is the target of comments they consider harmful may exercise their right of reply through the same channels and means available to the original author, this being the appropriate avenue for contradiction.

6.5. REMOVAL OF COMMENTS BY THE PLATFORM:

Travel Classifieds may, at its sole discretion and without any legal obligation to do so, remove comments that:

Constitute hate crimes, discrimination, or apology for violence;
Contain sensitive personal data exposed without authorization;
Are proven fraudulent or criminal by judicial decision.

7. MODERATION AND CONTENT REMOVAL

7.1. Travel Classifieds does not carry out prior control of ads, but will act in good faith to moderate content that violates these rules.

7.2. We reserve the right, at any time and without prior notice, to remove ads we deem inappropriate, without this generating any right to compensation.

7.3. Users can report inappropriate content through the service channels.

8. LIMITATION OF LIABILITY

8.1. The Platform acts as a mere dissemination vehicle. We ARE NOT responsible for:

Any negotiation, contract, or relationship established between users;
Damages, losses, injuries, or losses resulting from in-person or virtual interactions;
Truthfulness, quality, safety, or legality of the published offers;
Conduct of users inside or outside the Platform;
Comments, evaluations, or manifestations exchanged between users;
Content published by users that may be considered offensive or harmful by third parties.

8.2. It is the exclusive responsibility of the user to carry out their own verifications, research, and due diligence before closing any agreement or taking any action based on third-party comments.

9. PAYMENTS AND TRANSACTIONS

9.1. Travel Classifieds may offer paid ad plans or premium features, the conditions of which will be specified at the time of contracting.

9.2. Paid amounts will not be refunded, except in cases provided by law or expressly indicated.

9.3. Financial transactions between users (payments for services, accommodation, etc.) are the sole responsibility of the parties involved.

10. INTELLECTUAL PROPERTY

10.1. All code, design, logos, and trademarks of Travel Classifieds are the exclusive property of the Platform.

10.2. The user grants the Platform a non-exclusive, royalty-free, worldwide license to display, distribute, and store the content published by them, exclusively for the purposes of operating the service.

11. PRIVACY AND DATA PROTECTION

11.1. The collection and processing of personal data follows global Privacy Policies, duly different between countries and nations.

11.2. By using the Platform, the user consents to the collection and use of their information as described in that policy.

12. GENERAL PROVISIONS

12.1. These Terms constitute the entire agreement between the parties, superseding previous understandings.

12.2. Tolerance regarding the breach of any clause shall not constitute novation or precedent.

12.3. We reserve the right to change these Terms at any time, upon notification to users or publication of the updated version on the Platform.

12.4. Users who do not agree with the changes must stop using the services.

13. JURISDICTION AND APPLICABLE LAW

13.1. These Terms are governed by the laws of the Federative Republic of Brazil.
